直接射杀!美国刚刚也发生“昆山龙哥”事件!警方这样说

昆山龙哥”的事迹传遍天下,引发人们对“正当防卫”的讨论。恰在此时,美国也发生一起类似事件。


8月28日凌晨,一名Uber司机半夜载客回家,途中被一辆皮卡逼停,皮卡司机手里拿着东西,嘴里叫嚷着:“我有手枪,你想我TMD打死你吗?”不过话音刚落,Uber司机果断掏枪将皮卡司机射杀。

当地警方随后召开新闻发布会,警长表示:这是一个“完美”和“经典”的正当防卫案,不会对Uber司机提出任何指控。美国律师也表示,整个过程Uber司机不但没有做错,还应该提出嘉许,因为他既保护了自己,也保护了乘客的安全。


这件事发生在星期二凌晨。据报道,37岁的Uber司机罗伯特·韦斯特莱克(Robert Westlake)仍在通宵达旦地工作,在温特黑文(Winter Haven)一间酒吧载了一名醉酒的女乘客回家。途中,一辆皮卡车在对向车道强行超车后,将他逼停了下来。


之后,皮卡车司机跳下车,右手拿着东西朝韦斯特莱克走过来,并且大喊:我有一把手枪,你想我TMD打死你吗?“


然而话音刚落,就在皮卡车司机走出行车记录仪的范围时,听到一声枪响。然后就是女乘客和韦斯特莱克的感叹声:“Oh! my god!”


原来,Uber司机韦斯特莱克已经率先开枪,击中皮卡车司机胸部。


接下来,韦斯特莱克打电话报警,并且下车给皮卡车司机做心肺复苏,但是皮卡车已经死亡。


后来,警方调查发现,皮卡车司机名叫杰森·博克(Jason Boek),今年34岁,警方从他的手机通讯记录发现,他此前一直跟女朋友吵架,看着女朋友去了酒吧,然后又看到韦斯特莱克的车停在酒吧前面。估计是以为女朋友上了韦斯特莱克的车,说要TMD干死Uber司机。

而开枪的Uber司机韦斯特莱克也不是一般人,他刚刚完成警察学院的训练,除了当Uber司机外,还是兼职保安人员,他有合法的持枪证,也有隐秘持枪证。根据佛罗里达的法律规定,Uber司机在遵守法律的前提下,可以携带枪支。


也就是说,Uber司机的一切行为都没有违法。

警长:这是一宗完美的正当防卫案

当地波尔克县(Polk County)警方在星期二举行了新闻发布会,警长格雷迪·贾德(Grady Judd)表示:这是一起“完美”和“经典”的正当防卫。

贾德说,经过调查,当时在酒吧外面的时候,博克的女朋友发现一名女子喝醉了,出于好心让她先上车,而自己并没有上车,博克以为上车的是自己的女朋友,所以追了上去。


贾德毫不留情面地痛批已经被打死的杰森·博克,他说:“好人会带枪,他们会开枪打你。许多人,就那么死了,别去惹别人。”贾德随后补充讽刺道:“感谢杰森事先以书面形式向我们提供他的犯罪意图,它有助于为Uber司机罗伯特·韦斯特莱创造一个完美的正当防卫案例。”


贾德还说:这完全就是合理的凶杀案。你有权保护自己,这是一个典型的正当防卫案,这是这个法律存在的目的。

韦斯特莱克在事后接受采访时称,他不想射杀这名男子,但如果他不这样做,他担心自己可能会丧命。“拥有隐藏持枪证的人,没有人会想使用他们的枪支。他们有枪是用来以防万一,保护自己。”韦斯特莱克说。


Uber则回应称,会配合警方调查,该公司在一份声明中说:“我们对这一不幸事件感到悲伤,并将继续与警方合作进行调查。”


而博克随后被网友人肉出来,他是一名理发师,而且犯罪记录不断,包括殴打重罪,看来和“昆山龙哥”的犯罪记录有得一拼。


对于“昆山龙哥”被反杀的事件,美国刑事辩护律师表示有点防卫过当的嫌疑,但是对于佛罗里达州这起Uber反杀皮卡司机事件,刘龙珠律师则认为是“毫无疑问的正当防卫”,并且值得嘉许。


首先这是一条单向单车道的马路,皮卡车司机来势汹汹地逼停Uber后,Uber司机已经无路可逃,这种情况下,在美国不管有没有“Stand your ground law”,司机都可以正当防卫。


其次,在皮卡车司机下车走过来说:我有手枪,你想让我杀你吗?这句话的时候,而且手里确实拿着东西,不管是不是手枪,对Uber司机来说,都可以合理地认为是手枪,他的生命处于危险当中。更何况,Uber司机坐在车内,空间狭小,不仅跑不掉,万一搏斗的话还处于弱势地位,开枪还击一点问题都没有。警方说是“经典”的正当防卫也是没有问题的。

Uber司机的做法不仅没有违法,而且在道德层面还是值得嘉许的,因为他不仅保护了自己,还保护了车内乘客。

An Uber driver who shot and killed a man in a “classic stand-your-ground” case in Florida has spoken out, saying he’s filled with guilt.

“Everyone tells you what you did was right, but you feel like, did I have to… after the fact? Someone comes at you like that you really don’t have much time to think,” Robert Westlake, the Uber driver, told ABC Action News on Aug. 30.

“I wish the whole chain of events didn’t happen,” Westlake said of what led up to the shooting. “When he said pistol gonna shoot and he had it up at me… who just says that? Who only just threatens that.”

A dashcam video released by the Polk County Sheriff’s Office shows Jason Boek approach Westlake’s car before he was shot. Boek apparently thought that his girlfriend was inside the Uber car when he tried to force it off the road, CBS News reported.

“This is a justifiable homicide all day long,” Polk County Sheriff Grady Judd said, saying it is a “classic stand-your-ground” case. Judd said that Westlake won’t be charged with a crime.


Video shows Boek yelling: “You know I got a pistol?…You want me to…shoot you?” In the clip, Boek gets out of his truck holding up his cell phone like a handgun as he approached the car, CBS reported.

After the shooting, Westlake immediately called 911 and started to perform CPR. “I thought for a moment I hit him in a spot where he can survive. I thought for a moment after doing compressions I had him back,” Westlake told ABC Action News.

“He ran me off road, jumped out of his vehicle. I couldn’t get away. He came towards me shouting he’s got a pistol. Reached toward his waistband,” Westlake told a 911 operator. “I’m applying pressure to the wound. He’s faintly breathing.”

Westlake told the ABC affiliate that Uber and Lyft suspended his account. Uber told him that even if he is cleared of any wrongdoing, his account might be reinstated, but he doubts that will happen as he violated the company’s no gun policy.


Details in the Case

According to the Polk County Sheriff’s Office, in the incident, a woman had called for an Uber to take her home from the Grove Lounge on U.S. Highway 27 in Dundee after she was drinking, ClickOrlando reported.

Westlake, her Uber driver, drove the woman west on Dundee Road. A woman who had assisted the drunk woman began getting text messages from Boek, her boyfriend. Boek apparently thought that woman got into the Uber car, the report said.

Neither Westlake or the woman knew Boek, who has a lengthy criminal history, including arrests on charges of aggravated battery, battery, burglary, marijuana possession, forgery, larceny, resisting arrest, and violation of probation, the report said.

Deputies said they obtained a search warrant for Boek’s truck and found marijuana and a glass pipe containing methamphetamine residue.

“Good people carry guns and they will shoot you. You may be used to bullying people … I highly recommend against that if you value your life. Leave people alone. They may have a gun and shoot you,” Judd said in a warning to “hot heads,” ClickOrlando reported.
